Rules & Requirements

These Rules & Requirements form part of your agreement with HolaHome and must be read together with our Terms & Conditions and Privacy Policy.
By creating an account or using the platform, you agree to all of the following.
 
1) Platform Use
1.One account per person. Do not create multiple accounts.
2.Account security. Keep your password confidential. HolaHome does not currently provide two-factor authentication; you are responsible for keeping your login safe.
3.Accurate details. Provide true, complete information and update it if anything changes.
4.Prohibited use. Do not upload unlawful, defamatory, discriminatory, or infringing content. Do not attempt to scrape, copy, reverse-engineer, or misuse the system.
5.Shared access. If you let a spouse, colleague, or representative use your account, you remain fully responsible for their actions.
 
2) On-Platform-Only Communication (Binding Rule)
1.Single source of truth. All conversations, approvals, and instructions must happen inside your HolaHome dashboard chat.
2.Automatic translation. The chat supports real-time translation, so you and your lawyer/agent can communicate in any language without leaving the platform.
3.Evidence & audit trail. Messages and uploads in the dashboard create a time-stamped legal record.
4.No responsibility off-platform. If you contact a lawyer, agent, or HolaHome staff outside the platform (email, WhatsApp, Telegram, phone, etc.), HolaHome accepts no responsibility whatsoever for delays, errors, losses, privacy breaches, or miscommunication that result.
5.Verification. If you receive advice or instructions elsewhere, do not act on them until they are confirmed inside your dashboard chat.
 
3) Payments (Dashboard-Only)
1.Pay only through your dashboard. All invoices, payment links, and bank details appear exclusively in Dashboard → Payments.
2.We never send payment emails. Ignore any message requesting payment; always check the Payments tab.
3.Verify before paying.
•Step 1: Confirm the exact amount and recipient in Dashboard → Payments.
•Step 2: If anything differs elsewhere, do not pay—contact support through your dashboard chat.
4.Off-platform payments = your risk. HolaHome is not liable for, nor able to recover, funds paid to accounts not listed in your dashboard.
5.Receipts. A payment is officially registered only when the funds arrive and clear in the designated account shown in your dashboard.
 
4) Property Purchase Rules
1.Reservation. To take a property off-market, sign a Reservation and pay €3,000 to the official account shown in your dashboard or contract.
2.Lawyer choice for due diligence.
•You may appoint your own independent lawyer, or
•You may use a HolaHome-introduced lawyer (independent, bar-registered). Fees apply as stated in their engagement letter.
In both cases, all communications and document approvals must remain inside the HolaHome dashboard.
3.PPC signing. Engage a lawyer before signing the PPC (Private Purchase Contract). HolaHome coordinates the process, but legal advice comes from your lawyer.
4.Due diligence scope. Typical checks include title, debts/charges, boundaries, licences, community statutes, and tax position.
5.Deadlines. Respect offer validity, Reservation expiry, PPC signing, mortgage, valuation, and notary completion. Missed deadlines can lead to penalties or cancellation.
6.NIE & banking. You need an NIE (Foreigner ID) to buy and pay taxes. A Spanish bank account is recommended for utilities and community fees.
7.Power of Attorney (PoA). If you cannot attend, your lawyer can act through a PoA; notarisation and apostille costs are yours.
8.Surveys. Technical surveys are recommended for villas or older homes.
9.Viewings. Be punctual; cancellations require at least 24 hours’ notice unless it is an emergency.
 
5) Visas & Immigration Rules
1.Eligibility first. Each visa case begins with the Eligibility Q&A in your dashboard. Once eligible, your Checklist appears; your lawyer can add Additional Documents when required.
2.Truthful disclosure. Provide full, accurate information. Misrepresentation or omission can result in refusal and loss of fees.
3.Document standards. Follow checklist guidance for apostilles, sworn translations, validity, and file type.
4.Authority control. Embassies and authorities control appointments, timelines, and outcomes. HolaHome and lawyers prepare your case; approval is not guaranteed.
5.Payments. All visa payments occur only within your dashboard.
💡 Visa fees, as well as applicable VAT, are displayed in your dashboard before checkout.
Additional costs for health insurance and sworn translations depend on your age and the number of documents requiring translation.
 
6) Fees, Refunds & Chargebacks
1.Transparency. All fees and VAT are shown before checkout; invoices are stored in your dashboard.
2.Late/failed payments. May pause or cancel your process; contractual obligations remain yours.
3.Refund summary:
•Reservation (€3,000): normally non-refundable unless your Reservation Agreement allows refund for a defined legal defect or seller default.
•Visa legal fees: first instalment non-refundable; second instalment not charged if the application is refused—except when refusal results from your misrepresentation or non-cooperation.
•Other fees: follow your signed agreements and Terms & Conditions.
4.Chargebacks. Filing a chargeback without contacting us first may lead to suspension and recovery of related costs.
5.Currency risk. Exchange-rate movements are your responsibility.
 
7) Documents & E-Signatures
1.Accepted formats: PDF (preferred), JPG/PNG, DOC/DOCX. Apostilles and sworn translations must be high-resolution PDFs.
2.File quality. Upload complete, legible documents—no glare or missing pages.
3.Naming. Use clear filenames (e.g., Passport_Emma_Jones_2025.pdf).
4.Approval. A document counts only once marked Approved by your lawyer in the dashboard.
5.E-signing. HolaHome uses certified e-signature platforms; electronic signatures are legally binding under EU law.
 
8) Scheduling & Appointments
1.Timeline visibility. Your dashboard displays milestone dates such as Reservation, PPC, mortgage, valuation, notary, visa submission, biometrics, and decision.
2.Attendance. Attend appointments with original documents unless covered by a valid PoA.
3.Rescheduling/missed slots. Subject to availability; missed appointments may incur additional fees or delay.
 
9) Data Protection & Security
1.GDPR compliance. Personal data is processed under EU GDPR and our Privacy Policy.
2.Encryption. Data is encrypted in transit and at rest, accessible only to your authorised team.
3.Incident response. If a data breach affects you, we will notify you as required by law.
4.Your duty. Use a strong password, log out on shared devices, and report any suspected compromise immediately.
 
10) AML/CTF & Compliance
1.KYC/AML checks. We may request proof of identity, address, and source of funds/wealth, and conduct sanctions/PEP screening.
2.Non-compliance. Failure to provide these documents can suspend or terminate your case without refund.
3.Regulatory changes. Tax and visa rules evolve; updates will appear in your dashboard and your lawyer will guide next steps.
 
11) Independent Professionals & Third-Party Providers
1.Independent lawyers. Whether you appoint your own lawyer or a HolaHome-introduced one, they act independently in your legal interest. HolaHome does not influence legal advice.
2.Other service providers. Banks, brokers, translators, surveyors, and FX companies are independent; HolaHome is not responsible for their actions.
3.Guidance vs. contracts. Dashboard timelines and estimates are guidance only. Signed contracts and lawyer advice take priority.
 
12) Off-Platform Contact & Liability (Reminder)
1.Strict rule. HolaHome is not responsible for any result of communication or payment made outside the platform.
2.Identity risk. Emails and social-media profiles can be faked. Always verify inside your dashboard.
3.Proof. Only dashboard chat and uploads are accepted as legal evidence of communication or approval.
 
13) Approvals, Evidence & Changes
1.Valid evidence: dashboard chat messages, lawyer-approved documents, and digitally signed PDFs stored in your dashboard.
2.Invalid evidence: screenshots, external emails, or phone statements—unless confirmed in dashboard chat.
3.Changes. Any change to fees, deadlines, or required documents becomes effective only once posted in your dashboard.
 
14) Breach & Consequences
1.If you break these rules (e.g., paying or instructing off-platform), HolaHome may:
•Pause your case until communication returns to the dashboard;
•Refuse responsibility for any resulting issues;
•Charge administrative costs for correction;
•Suspend or terminate your account for serious or repeated breaches.
2.No refunds will be granted for losses caused by breaching on-platform requirements.
 
15) Updates to These Rules
 
HolaHome may update these Rules at any time. The effective date and a short summary of changes will appear in your dashboard. Continued use of the platform means you accept the latest version.

•NIE: Foreigner ID number required to buy property in Spain
•Reservation: €3,000 deposit to hold a property off-market during due diligence
•PPC: Private Purchase Contract (typically raises total deposit to ≈10 %)
